Welcome to the Language Collective!

These Terms of Service constitute an agreement between you and the Language Collective. By using our services, you agree to these terms and conditions. We may make changes to our Terms of Service from time to time, to reflect changes in our services and any changes in the law. We will publish all changes to our Terms of Service on our website, www.languagecollective.africa. If you do not agree with our Terms of Service, please do not register for or use any of our services.

By using our services, you agree that you are at least 13 years old, or have the permission of your legal guardian to use our services, and that the use of our services will not violate any applicable laws. You understand and agree to use our services “as is”. You understand that you use our services at your own risk. You agree:

  • To use a strong password.
  • To keep your password safe.
  • To not share your password with others.
  • To follow our rules and any applicable laws.
  • To not use our services while driving or operating any machinery.

We take your privacy seriously, and any personal information you submit is subject to our Privacy Policy, which you can access at www.languagecollective.africa/legal-stuff/

Using our Services

Using our services gives you access to our content (including, but not limited to text, images, information, software, web-pages, audio and other media). This access does not give you ownership of any of our content, intellectual property rights, or the right to use any of our branding. The content is available on our website (www.languagecollective.africa), social media pages and mobile application.

You are given limited, personal, non-transferable, non-sublicensable, worldwide and non-exclusive use of our content, for your personal, non-commercial use. You may not copy, modify, loan, sell or otherwise transfer any rights to our content.

Content is accessible from most mobile and internet-connected devices. Devices may differ, so content may appear differently on various devices. You may also only use the mobile application on a single device. Should you change devices, please notify us, so that we can link your new device to your new mobile device.

The services we provide may contain Third Party owned content, and links to other websites, services and apps. We do not endorse, sponsor, recommend, or otherwise accept responsibility for any Third Party Websites, services or apps.

We reserve the right to update content, and change prices and payment terms from time to time, based on commercial and operational reasons, as we see fit. We will take reasonable steps to notify you via email, our website and social media pages, of these changes.

We may from time to time send you communication with regards to our services. You may opt out of these communications at any time.

Payment information

The Language Collective uses a payment gateway to process payments. As such, you do not submit any of your payment information directly to us. We also do not store any of your payment information.

Credit card transactions are processed by PayFast, being an approved payment gateway. You may visit their website, www.payfast.co.za to view their security certificate and security policy.

We only process refunds to the credit card used at the time of purchase. Please allow 30 days for the refund to appear on your credit card statement. Any refunds granted are subject to our terms of purchase.

No representations or warranties

We, our officers, employees, contractors, suppliers, do not guarantee that our services will always be available, uninterrupted, and free from bugs and viruses. We recommend that you install your own anti-virus software. You are responsible for the ownership and maintenance of your own mobile and internet-connected devices through which you access our services.

We may restrict or suspend, the availability of our services, for commercial and operational reasons. We will take reasonable steps to notify you of any changes to the availability of our services, but this may not be possible. Access to our services may be limited or slow during periods of peak demand, system upgrades, malfunction, or during periods of scheduled or unscheduled maintenance, or for any reason beyond our control.

You understand and accept that you use our services at your own risk. We do not make any warranties or representations of any kind, whether express or implied. We do not assume responsibility for any improvement in your language learning through the use of our services. We take reasonable care to ensure that our content is accurate and up to date, but we cannot guarantee the accuracy or completeness of our content.

Indemnity

You agree to indemnify us and hold us, our officers, employees, contractors, suppliers, harmless of any losses, damages, cost, expense (including reasonable legal fees) or other liability, arising from the use of our services.

Terminating this agreement

You may end your legal agreement with The Language Collective at any time by stopping your use of the Language Collective’s services.

We reserve the right to terminate your account at any time if we reasonably believe that:

  • You have violated the terms of service.
  • You have created a risk or legal exposure for us.
  • Your account should be removed due to possible unlawful conduct.
  • You have infringed upon our copyright and/or intellectual property.
  • The provision of our services are no longer commercially viable.

We will take reasonable steps to notify you via email, our website or social media of the termination.
